The regulatory scenario is seen as quite complex in Brazil. The Civil Framework of the Internet is a relatively recent legislation (Law No. 12.965 / 14) which is undergoing a major update. In August 2018, the General Data Protection Act (LGPD) was approved, establishing the use, protection and transfer of personal data in Brazil, both privately and publicly. The legislation is based on the General Data Protection Regulation (GPDR), rigid general data protection regulations approved by the European Union three months earlier.
The new Brazilian legislation establishes who are involved and what are their duties, responsibilities and penalties in the civil sphere. With clarity and heavy fines for non-compliance, the LGPD aims to ensure privacy and allow greater control over personal data, contributing to the development of the sector in the country. The LGPD goes into effect in February of 2020.
